A building contract (also known as a construction contract agreement) is a legal document that outlines the terms and conditions of a construction project.
It is an agreement between the owner of the property (the client) and the contractor who will be responsible for the construction (the contractor), collectively referred to as the parties to the construction contracts. The construction contract agreement should be in writing and should include all of the following information:
- The details of the property owner are set out within construction contracts.
- The general contractor information such as their license number, permits to work on site and any other relevant documents required are set out within construction contracts.
- The address of the business site is also noted within the construction contracts.
- The scope of work of the general contractor under the construction contracts.
- Details of the services rendered and the exact nature of such services rendered.
- Construction contracts also set out the fixed price of the building projects as well as the project plans.
- If the project is new construction or if the project is sizable (lasting more than 2-3 months) the contractor will demand that they are paid overtime or at certain “checkpoints”. The client is responsible for ensuring that the project is going accordingly and, if certain parameters are being met, to make payment and cover any other cost such as materials and labor.
- The governing law, such as local laws, which apply to construction contracts. This includes the requirement of permits required by the clients for construction and any permits needed by the contractors.
- The contract form also covers clauses such as insurance taken out by each party thereto and insurance obligations by each party to be abided by until the completion of the contractors work.
- The timeline for completion of the building projects under construction contracts.
- The amount of labor put in by the contractor and the contractors team.
- The cost of the project (contract price or lump sum contract) as well as any repayment of costs incurred by the general contractor. Thus, the construction contract sent out the total costs related to the construction contract such as materials and labor to be included in the total price.

- The responsibilities of the client and the contractor.
