Who should use these Indemnity Documents? Anyone that offers activities that may involve an element of risk, such as team-building events, horse riding, extreme sports, game drives should obtain an indemnity from everyone taking part in the activity. An indemnity or disclaimer can help to protect against the possibility of claims in the event of loss or damage to property, or the unexpected worst-case scenario of injury or death to a person whilst taking part in the activity.
In addition to the Indemnity Form, you may also want to erect Indemnity Notices in your parking and reception areas. And add a notice to your children’s play area (if you have one).
What do you need to do to use the Indemnity Documents?
Read the document to ensure that it suits your requirements. Make changes as required.
Complete the nature of the activity being offered, for example horse-riding, scuba diving, transportation.
Get the person taking part to complete the details and sign the Indemnity form.
Print the indemnity notices as desired, and ensure that they are placed in a prominent position on the property, for example throughout the parking lot, outside reception, near the playground. Depending on the location, a number of notices may need to be put up
Remember to take all precautions. An indemnity may not protect you in every eventuality, and negligent actions may still expose you to legal action.
