  • In addition, the act also specifies that an employee is entitled to days family responsibility leave when necessary. This is leave that is granted, for example, to employees who need to take time off work to attend to family matters or a family occasion such as the illness of a family member, the birth of a child or a death in the family.
  • The contract of employment also outlines the terms and conditions under which the employee works, including their salary, termination conditions and notice of termination. For example, the employment agreement may state that the employee agrees to work for a specific period for a certain number of hours and that they will receive normal/ full pay for their services during this time.
  • The employment contract may also include provisions related to duties the employee undertakes to perform during the employee’s term of employment, confidentiality, and any referred company policies. For example, if the employee is working as a domestic worker, the contract may specify that they are not allowed to disclose confidential information about the employee’s employer or their employer’s family.
  • The Contract of employment sets out the duties and responsibilities of both parties, confidentiality on the side of the employee and consequences for breach of such confidentiality clause, as well as what may constitute as valid grounds for employment to be terminated under this document whilst also addressing an employee’s last working day.

However, it is important to note that the terms and conditions of employment, such as the hours and employee works, may vary subject to the company, industry and the nature of the job that the employee is employed to do.
  • Subject to provisions referred to within employment legislation any changes made to the employment contract, such as changes to the hours an employee works per week, or any other changes made by an employer/ company or at the request of an employee must be in writing and signed by both the employer/ company representative and employee to constitute a valid amendment.
